A 17-year-old teenager is facing several charges, including a murder charge.
The teen, Rafael Harvey, and another unidentified person opened fire during what appeared to be an attempted carjacking at a Citgo gas station in Englewood, Chicago on Tuesday, January 3.
Harvey was charged with several felony crimes on Thursday, January 5, including first-degree murder, attempted carjacking, and attempted first-degree murder, after he shot two men in their car. The shooting left one of the men dead and the other was seriously injured outside the gas station at around 2:30 am on Tuesday.
Harvey was not present during his Thursday court hearing because he was still hospitalized due to a gunshot wound in his shoulder, according to the police. Even though Harvey was absent, the judge set his bond at $1 million.
Authorities are yet to identify or arrest the accomplice they believe accompanied Harvey.
According to Anne McCord Rodgers, the Assistant State Attorney, the two assailants attacked two people, a 45-year-old man and a 36-year-old man.
Harvey and the other gunman pulled up to the Citgo gas station in a stolen Hyundai as the 36-year-old man was entering the convenience store to buy drinks.
Rodgers said that Harvey and his accomplice waited until the two victims were back inside their car, and proceeded to ambush them.
As the suspects were trying to open the car door, one of the car occupants pulled out a gun and shot Harvey in his right shoulder. That resulted in a full-blown gun battle as Harvey and the other suspect unleashed their weapons and fired several rounds at both victims.
The 36-year-old man exited the vehicle with a .357 gun as the two assailants continued firing their guns, then got back into the stolen car and fled the scene.
The 45-year-old man had several gunshot wounds and was transported to the University of Chicago Hospital, where doctors pronounced him dead.
The 36-year-old man suffered gunshots to both legs and was transported to the same medical center. He survived the ordeal and is in fair condition, according to the police.
Surveillance cameras around the gas station captured the incident. Police then tracked the stolen Hyundai from the gas station using multiple surveillance cameras and plate readers. They found that the vehicle had stopped at the St. Bernard Hospital, where the unidentified accomplice abandoned Harvey.
According to Rodgers, police received a complaint about Harvey earlier in the day from Harvey’s girlfriend, who claimed he had threatened her with a gun.
Police located the stolen Hyundai a few houses away from Harvey’s home but have not yet found the second suspect. The next hearing will be on January 12.
